The Building and Construction Tribunal - Appeals

As per CAP 623 of the Laws of Malta titled the BUILDING REGULATION ACT, an appeal against any ruling, decision, order, or direction issued by the Building & Construction Authority may be submitted to the Building & Construction Tribunal by electronic email on info.bct@bct.org.mt.

The following are the procedures for an applicant to lodge an appeal to the Building & Construction Tribunal (BCT) under CAP 623, BUILDING REGULATION ACT:

Applicants are to submit a signed copy of all necessary documentation, to be filed by electronic mail on info.bct@bct.org.mt and which must include:
– Appeal submission, justification and a technical report if necessary
– All Plans and Drawings
– Site plan
– PA permit if applicable
– All quoted permits / decisions, cited or referred to documents have to be presented and not just the reference number cited – eg quoted PA permit – necessary copies of the cited permit must be presented

Time frame to submit appeal – twenty (20) days from the issue of the ruling, order or direction issued by the Building & Construction Authority.

In the appeal submission, applicant is to name any witnesses which he/she intends to produce

The decisions of the Tribunal in regard to appeals submitted to it against any ruling, decision, order or direction issued by the Building & Construction Authority shall be final except with respect to points of law, from which there shall lie the right to appeal to the Court of Appeal (Inferior Jurisdiction). Appeals to the Court of Appeal (Inferior Jurisdiction) from appeals decisions of the Tribunal shall be made by means of an application filed in the registry of that court, within twenty (20) days from the date on which that decision has been published according to law.
